Dealing with Nitrogen Deposition and PFAS in Dutch Project Financing

Nitrogen deposition and PFAS have put many projects in the energy, infrastructure, agriculture and housing sectors in the Netherlands on hold. For nitrogen, this is the result of a ruling of the Council of State (Raad van State), in which the regulations on nitrogen deposition were annulled because they were in breach of European law. Permits can no longer be granted on the basis of these regulations and projects that were not required to have a permit under the regulations, now do require a permit. Even irrevocable permits are at risk of withdrawal. For PFAS, this results from strict new policy rules on dealing with soil that is contaminated with PFAS. As a result, only very few parties are willing to accept this soil.

Policy makers are working on short term and longer term solutions for this problem, whilst other interested parties (construction companies, energy producers, farmers, etc.) voice their concerns and look for ways to safeguard their positions.

In this session, global law firm Dentons will discuss the current state of affairs and possible solutions in the context of project financings with policy makers, financiers and developers.
